Terms And Conditions

Please read these Terms and Conditions carefully as they affect your rights and liabilities under the law. Together with our current website prices, delivery details, contact information, and privacy policy, they form the entirety of our agreement regarding the supply of goods to you by us.

By using the kmkpinoy.co.uk website (“KMK PINOY ORIENTAL website”) and/or placing an order with us, you are deemed to accept these Terms and Conditions. If you do not agree with them, please do not register for or use the KMK PINOY ORIENTAL website.

To use any service provided on the KMK PINOY ORIENTAL website, you are required to register.

We reserve the right to change or update these Terms and Conditions at any time. Any such changes will take effect immediately upon being posted on the KMK PINOY ORIENTAL website.

It is your responsibility to review the Terms and Conditions each time you use the website. If you do not wish to accept any new terms after they come into effect, you should stop using the website.

Continued use of the KMK PINOY ORIENTAL website after changes are made indicates your acceptance of the updated Terms and Conditions.

  • “you”, “your” – the person or party using the website  

  • “KMK PINOY ORIENTAL website”, “Website” – kmkpinoy.co.uk  

  • “working day” – any day other than Saturday, Sunday, or a bank holiday in England and Wales  

 

1. Registration

1.1 You must be over 18 years old and complete the registration process to use the KMK PINOY ORIENTAL website.

1.2 You must ensure that all registration details are accurate and up to date.

1.3 You must inform us immediately of any changes to your personal details.

 

2. Pricing and Product Availability

2.1 Prices shown on the KMK PINOY ORIENTAL website include VAT but exclude delivery charges.

2.2 Prices and product availability are subject to change without notice.

 

3. Payment

3.1 We do not accept cheque payments. Accepted payment methods include Mastercard, Visa, Switch, Maestro, and Delta debit cards, Paypal or BACS Transfer. 

3.2 Cash on Delivery payments are only available for local delivery services by KMK Pinoy Oriental Ltd staff only, i.e. not by third party delivery firms. 

3.3 Click & Collect or Local Delivery payments can be made via messenger over the phone, in store or on line.

3.4 Goods with age restrictions must be paid for using a credit card.

3.5 By checking out, you authorise payment via our online facility or other payment solutions available. Payment is typically taken on the day or the day after your order is received and verified.

3.6 Ownership of goods transfers to you upon delivery. Risk of loss or damage also passes to you at that point.

3.7 We use Stripe to process online transactions. For more information, refer to the Stirpe Privacy Statement.

 

4. Delivery

4.1 Orders are processed within 1 – 4 working days after payment is received, depending on the delivery option selected.

4.2 Delivery times may vary due to demand or unforeseen circumstances. The dispatch date will be confirmed at checkout.

4.3 Orders placed after 11am or will be processed on the next working day.

4.4 Orders placed on Fridays using overnight shipping will be dispatched the following Monday.

4.5 Goods will be delivered to the shipping address provided in your order.

4.6 Changes to orders must be made before dispatch.

4.7 We do not ship outside of the UK.

4.8 Goods are considered delivered when the courier used records the delivery complete. KMK Pinoy Oriental Ltd take no responsibility for goods left outside premises after delivery nor in any designated or safe place arranged with the courier.

 

5. Amendment of Orders

5.1 We reserve the right to cancel orders if payment is not received on time.

5.2 No amendments can be made once an order is placed.

5.3 Orders may be placed on hold pending amendment approval. We reserve the right to cancel or refuse amendments.

 

6. Returns/Exchanges

6.1 Requests for returns or exchanges must be made within 10 working days of the invoice date.

6.2 Returns or exchanges must be authorised by us.

6.3 Unless clause 8.1 applies, you are responsible for delivery charges, which will be deducted from your refund.

6.4 We reserve the right to refuse returns or exchanges for reasonable or unethical reasons.

7. Electrical Appliance Return and Warranty Policy

7.1 Return Policy

  • Faulty products may be replaced within 14 days of purchase or delivery (whichever is later). 

  • Conditions:

    • Product must be unused, in original packaging, with all accessories. 

    • Proof of purchase required. 

    • Replacements only; no refunds. 

    • Return shipping/processing fees are the customer’s responsibility. 

    • Used, damaged, modified, or incomplete products are excluded. 

7.2 Warranty Coverage

  • General Appliances:

    • 1-year limited warranty for manufacturing defects. 

    • Replacements only; no refunds. 

    • Return fees apply and must be agreed upon before processing. 

    • Warranty is valid in the UK and non-transferable. 

 

7.3 Warranty Exclusions

7.3.1 General Exclusions

  • Misuse, accidents, unauthorised repairs.

  • Normal wear and tear (scratches, discoloration, etc.).

  • Consumables (batteries, cables, filters).

  • Damage from power surges or natural disasters.

 

7.4 Warranty Claim Process

 

7.4.1 General Appliances

  • Provide proof of purchase and warranty card.

  • Submit a Faulty Product Replacement Request Form with photo evidence.

  • Our team will guide the return/replacement process.

7.5 Customer is responsible to follow the instruction manual, retain receipt and warranty card and do not attempt unauthorised repairs.

7.6 Warranty is valid only in the UK and non-transferable. Refund is not available only replacements.

 

8. Out of Stock Products and Stock Levels

8.1 While we try to update our stock inventory on a daily basis, please note that stock levels are not in real-time so there may be a possibility that while you are ordering, your product may become out of stock. You can choose one of the three of options if your product is out of stock so that we can fulfil your order.

8.2 Please accept our apologies for the many products that are low stock or out of stock. Unfortunately, this is out of hands due to the complications with Brexit and restrictions placed on certain ingredients. We will endeavour to keep stock levels high and may we thank you for your continued patience.

 

9. Complaints Procedure

9.1 We will at all times try to provide you with good service at all times. In the event you are dissatisfied with any part of our service, please put your complaints in writing by email or post.

9.2 We will advise you of our findings and let you know the proposed action we propose to take in assisting your compliant.

 

10.Liability

10.1 If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email or telephone of the problem within 2 working days of the delivery of the goods in question.

10.2 If you do not receive goods ordered by you within 7 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 days of the date on which you ordered the goods. If you notify a problem to us under this condition, subject to condition 6 above, our only obligation will be, at your option:

10.2.1 to make good any shortage or non-delivery;

10.2.2 to replace or repair any goods that are damaged or defective; or

10.2.3 to refund to you the amount paid by you for the goods in question in whatever way we choose.

10.3 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under condition 10.2.3 above.

10.5 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

 

11.Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at KMK Pinoy Oriental Ltd, 35 High Street, Cosham, Portsmouth, Hampshire, PO6 3BT and all notices from us to you will be displayed on our Website from time to time.

 

12.Events Beyond Our Control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

 

13.Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

 

14.Privacy

You acknowledge and agree to be bound by the terms of our privacy policy.

 

15.Third Party Rights

A person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

 

16.Governing Law

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

 

17.Entire Agreement

These terms and conditions set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
